Labour Market Impact Assessment (LMIA)

What is Labour Market Impact Assessment?

A Labour Market Impact Assessment is an official permit or a document that empowers the Canadian employer to hire a skilled foreign worker legally into their company or business. A positive LMIA determines a strong need for a skilled foreign worker to fill the vacancy. Furthermore, it also denotes that no other Canadian worker or Canada PR Visa Holder is available or capable of doing that job. Therefore, Canadian Employers would need a positive LMIA to hire skilled workers overseas.

What is the process to get an LMIA?

Employer must acquire a positive LMIA from ESDC on behalf of the candidate to work in Canada. The LMIA application process differs from the type of program you are hiring for.

The candidate must follow the below process to achieve a positive LMIA:

  • Must meet the program eligibility requirements for both employer and employee
  • The employer must have a job bank account to authenticate the process
  • Submit the application and all documents such as LMIA application, business legitimacy proof, proof of recruitment, employment contract, and job offer
  • Submit the processing fee of the program on the official portal
  • The positive Labour Market Impact Assessment will be sent in a letter form

What are the minimum eligibility requirements?

  • A valid Canadian job offer
  • An employment contract
  • A copy of the LMIA
  • The LMIA number

What is Temporary Foreign Workers Program?

The Temporary Foreign Worker Program is a program created by the IRCC to provide opportunities for foreign workers to work with Canadian businesses. The TFWP allows people to work in the country for a prolonged period of time, with the possibility of extensions.

During this period the foreign worker is allowed to only work on a closed work permit/visa. The foreign worker is allowed to only work for one employer and they are eligible for work permit and visa.

What are the requirements for the Temporary Foreign Worker?

The most important requirement to employ a foreign worker is to have a LMIA done on behalf of the candidate

Other requirements to qualify for the TFWP are:

  • The candidate must have a job in Canada
  • The candidate must meet the experience, education and language proficiency needed for the role
  • The candidate has to leave Canada after their work permit expires
  • The candidate must prove that they can finance their and their family’s stay in Canada
  • The candidate must have a clean criminal record

To apply for the Temporary Foreign Worker Program, you must follow a series of steps as outlined below.

  • Provide a job offer to the candidate
  • Submit application for LMIA
  • The candidate needs to submit the application for Canada Work Visa and Permit
  • Post-approval your candidate is eligible to travel to Canada
